12.04.2024 sdas rejected C.R.M.(DB) No. 1079 of 2024 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Lalgarh Police Station Case No. 80 of 2023 dated 16.10.2023 under Sections 341/325/302/34 of the Indian Penal Code.

And In Re : Debendra Bhui .... petitioner Mr. Sourav Chatterjee Mr. Soumyajit Das Mahapatra Ms. Madhurai Sinha ....for the petitioner Mrs. Amita Gaur Mr. Asif Dewan ....for the State 1.

Learned Counsel for the petitioner submits he is in custody for 177 days. It is also submitted there was a free fight between the parties over measurement of land. Case and counter case were registered. Co-accused Bidhan Bhui has been enlarged on bail. Accordingly, he prays for bail.

2. Learned Counsel for the State opposes the bail prayer.

3. We have considered the materials on record. Petitioner dealt a fatal blow on the deceased. He does not stand on the same footing with co-accused who have been enlarged on bail. Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.
