1. Challenging the order dated 16th May, 2023 passed by the Rent Controller, Bardhaman in HRC(D) 54 of 2015, the instant revisional application has been filed.

2. The learned advocate for the petitioner after arguing the matter for some time submits that the petitioner would like to avail of the alternative remedy in the form of an appeal, revision review before the Tribunal, which is now functional.

3. Having regard thereto, he seeks leave to withdraw the application to apply before the Tribunal. He also seeks leave to take back the certified copy of the order. Having heard the learned advocate for the petitioner and considering the materials on record since the petitioner does not want to proceed with this application and intends to apply before the appropriate authority, let this aforesaid revisional application stand dismissed as withdrawn.

4. Leave is granted to the petitioner to take back the certified copy of the order by retaining the photocopy thereof on the file. Since the matter has been pending before this court since 4th April, 2024, the petitioner shall be entitled to benefit of the pendency of the revisional application.
