The report incorporates the statement of Biman Saha, who happens to be the de facto complainant of the case. The statement reflects that the de facto complainant amicably settled the dispute with his brother, who happens to be accused person. Having regard to the contents of the report and the subject matter of the case which relate to Behala Police Station Case No.273 of dated 26.09.2021 under Sections 341/323/506 of the Indian Penal Code, I am of the opinion that
further continuance of the proceedings are unwarranted in view of the changed circumstances.
Accordingly, all further proceedings arising out of Behala Police Station Case No.273 of 2021 dated 26.09.2021(corresponding to A.C.G.R. Case No.3810/2021) pending before the learned ACJM, Alipore as also the charge-sheet so submitted is hereby be quashed. Thus, CRAN 1 of 2022 along with CRR 1624 of 2022 is allowed.
Pending connected applications, if any, are disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
