Petitioners have challenged the proceedings of New Alipore Police Station Case No.04 dated 08.01.2022 which was registered for alleged commission of offence under Sections 448/380/120B of the Indian Penal Code.

The subject matter of challenge relates to dispute between a flat owner and the association of the said housing complex. The enclosures to the revisional application is a formal FIR, letter of complaint and the documents of the association which this Court cannot look into at this stage. None of the documents relating to the present stage of the case has been brought to the notice of this Court.

Accordingly, I grant liberty to the petitioners to approach this Court at the appropriate stage after the report under Section 173 of Cr.P.C. is filed by the investigating agency, if the same has not already been filed before the jurisdictional court and the documents under Section 207 of the Code of Criminal Procedure are handed over to the present petitioners.

With the aforesaid observations, the revisional application being CRR 1365 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
