Learned advocate appearing for the petitioner submits that from the possession of the present petitioner 256 grams of Heroin was recovered and from another accused, 250 grams of Heroin was recovered. So far as the other accused viz. Ratan Debnath is concerned, he has been granted bail on 24.03.2026 in CRM (NDPS) 335 of 2026.

Having considered the reasons assigned while granting bail to other accused in CRM (NDPS) 335 of 2026, I am of the opinion that the same grounds would also apply to the present petitioner. As such, the petitioner viz., Mahesh Sarkar be released on bail on the same terms and conditions as the other accused has been granted bail in CRM (NDPS) 335 of 2026.

Accordingly, the prayer for bail of the petitioner is allowed.

The application for bail, being CRM (NDPS) 767 of 2026, is, thus, disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
