(DB) No. 1523 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kaliyaganj Police Station Case No. 344 of 2022 dated 15.07.2022 under Sections 341/323/506 of the Indian Penal Code and under Section 6 of the POCSO Act.

And In Re : Najmul Haque @ Najimul Haque ..... petitioner Mr. Arani Bhattacharya ... for the petitioner Mr. Anwar Hossain Ms. Sreyashee Biswas ... for the State Learned Counsel for the petitioner submits he is in custody for nine and half months. He prays for bail. Learned Counsel for the State opposes the prayer for bail.

We have considered the materials on record. Minor victim has implicated the petitioner in the offence of penetrative sexual assault. In view of materials on record and gravity of the offence we are not inclined to grant bail to the petitioner at this stage.

The application for bail is, thus, rejected.
