Mr. Gupta, learned advocate appearing for the petitioner submits that the present complaint case was filed in the year 2020 for dishonour of cheque and is pending before learned Metropolitan Magistrate, 13th Court, Calcutta. Learned advocate submits that almost three years have passed, but till date examination under Section 251 of the Code of Criminal Procedure could not be completed as in a designed manner, the accused persons are evading the court of law. Learned advocate points out that the next date is fixed on 03.11.2023.

Learned Magistrate is directed to take steps so that the examination under Section 251 of the Code of Criminal Procedure is over on the next date so fixed or within a month thereafter. The learned trial court would thereafter fix at least one date in every 45 days so that trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties.

All stakeholders would cooperate with the learned trial court to conclude the trial at the earliest.

With the aforesaid observations, the revisional application being CRR 1366 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
