The main prayer in the writ petition is for release of a portion of the P.F. contribution of the petitioner/ employee with the P.F. Trustees of the Statesman Limited as a loan.

Counsel for the Trustees submits that the petitioner's service has been terminated after disciplinary proceedings. The said order of termination and the entire proceeding is a subject matter of a Reference before the authorities under the Industrial Disputes Act, 1947. 3.

Be that as it may, the petitioner's service has been terminated, all admitted dues of the petitioner, payable to a terminated employee, including the P.F., Gratuity and other benefits shall be released by the respondents to the writ petitioner within a period of ten days from date mandatorily and positively.

Any dispute with regard to the quantum paid to the petitioner may be raised in an independent proceeding or in any pending proceeding before the concerned authorities.

With the aforesaid directions, the writ petition is disposed of.

There shall be no order as to costs.
