In view of the fact that the interim order passed was only upto 22nd April, 2021, this appeal has now become infructuous.

However, this order shall not prevent the appellant to take appropriate steps for variation and/or modification of the impugned order passed by the learned Judge, 6th Bench, City Civil Court and in the event any application is filed for modification of the said order, we would request the learned Judge, 6th Bench, City Civil Court to decide the application as it is submitted that during the pendency of the suit, an arbitral award was passed. 3.

However, it appears from the impugned order that this fact was not brought to the notice of the learned Trial Judge that had resulted any such drastic order being passed on 12th April, 2021.

We make it clear that we have not gone into the merits of the appeal. The appeal and the application stand disposed of.
