Petitioner is aggrieved by the inaction of the police authorities as the information which was furnished to the Officer-in-Charge, Lalgola Police Station on or about March, 2024 was not acted upon. Petitioner and the private respondents are at loggerhead over a property. To that effect, it has been alleged that the respondents have assaulted the petitioner and also had taken away their valuables and jewelleries.

Mr. Ahmed, learned advocate appears on behalf of the State and submits that the police authorities have conducted an enquiry and have maintained peace and tranquility in their area. Be that as it may, since there is no information being furnished before this Court as to

whether police authorities exercise their rights to unearth any cognizable offence, I grant liberty to the petitioner to approach the jurisdictional Magistrate under section 175(3) of the BNSS.

Learned Magistrate would assess and ascertain regarding the veracity of the accusation which was forwarded to the Officer-in-Charge, Lalgola Police Station and thereafter pass necessary directions as he deems fit and proper.

With the aforesaid observations WPA 9738 of 2024 is disposed of.
