The petitioner is the plaintiff of the connected Title Suit No. 362 of 2017 pending before the 2nd Court of learned Civil Judge, (Junior Division) at Hooghly Sadar, District - Hooghly.

The learned Trial Judge by the order impugned being Order No. 21, dated March 01, 2023 has accepted the written statement with counter claim.

The said order is under challenge in the instant application under Article 227 of the Constitution of India. Mr. Sanyal, learned advocate for the petitioner submits that the copy of said written statement has not been served upon his client.

The defendants are directed to serve copy of the same to the plaintiff.

Time to file written statement to the counter claim is extended for a period of 14 days from date.

C.O. 1223 of 2023 is disposed of with the above terms without any order as to costs.
