Petitioner applied for licence by virtue of a new vacancy notification issued by the SCFS, Malda Sadar vide memo No. 470/SCF(M)/2024 dated May 13, 2024. After submission of his application his proposed godown cum shop room was inspected. He was called on for personal interview.

But since then though a considerable time has passed, no decision has been taken by the authority for selection of a candidate for impugned vacancy notification. Hence the petitioner has filed a representation to the concerned Sub-divisional Controller, Malda(Sadar) on April 17, 2025.

Learned counsel appearing on behalf of the state respondent submits that the selection process is yet to be concluded and it is still running. Thus, the instant writ petition cannot be proceed further.

Mr. Dutta, learned counsel for State further submits that the application is premature, so it is not maintainable.

Having heard learned counsel for the parties and also considering the fact that the selection process is yet to be concluded. I think it necessary to pass a necessary direction upon the concerned authority to conclude the selection process according to law. Under the above observation, the instant writ petition is disposed of.

Since no affidavit has been called for, the allegation made in the writ petition shall be deemed to have been not admitted.
