The respondent authorities submit that there is no scope of opportunity to pass any order since a criminal case had been initiated against the petitioner.

It is submitted on behalf of the respondent authorities that the petitioner's deceased husband is not entitled to any outstanding arrears or other consequential benefits in view of the fact that a criminal case had been filed against her deceased husband. In any event, it is submitted that the respondent authorities would respond to the application dated 14th October, 2021.

It is also submitted that the petitioner's husband has been acquitted from the criminal

case which has been initiated by the respondent authorities. This fact is disputed by the respondent authorities. The petitioner is directed serve a copy of the order of acquittal on the respondent authorities within the course of the week.

In view of the submissions made on behalf of the parties, the writ petition is disposed of by directing the respondent authority to respond to the communication dated 14th October, 2021 within 8 weeks from the date of communication of this order.

It is made clear that this Court has not gone into the merits of the case and the respondent shall not be influenced by any observation on the merits of this case.

Liberty is granted to all parties to act in terms of the copy of this order downloaded from the Official Website of this Court.
