WPA 10098 of 2021 31.03.2026 Mousumi Hazra-vs-State of West Bengal & Ors. Ct. 652,sl.6.

sk Mr.Ekramul Bari Mr. Siddhartha Sarkar Mandal Sk. Imtiaj Uddin ...for the petitioner Mr. Rezaul Hossain ...for the State

1. Parties are represented.

2. The writ petitioner in this case has prayed for disbursement of pension as well as an order for compassionate appointment of her in place and stead of her predecessor, the deceased non-teaching staff of the School.

3. It is informed that the respondent authority has taken appropriate steps and issued Pension Payment Order in favour of the writ petitioner dated November 10, 2025.

4. Mr. Bari, learned counsel for the petitioner has submitted that the petitioner has no further grievance so far as issuance of PPO, is concerned. He refers to the affidavit submitted by the Additional District Inspector of Schools (SE), Asansol/ respondent no. 4 to indicate that the petitioner's prayer for appointment on compassionate ground is dependent on issuance of PPO for calculation of the family income and ascertainment of the financial hardship of the family in terms of the existing rules,

in order to issue necessary order by the said respondent for compassionate appointment of the petitioner.

5. In such scenario, Mr. Bari insists that the writ petition be disposed of with appropriate order.

6. Having heard learned advocates for the respective parties and having considered the materials on record, it is found that the prayer of the petitioner for grant of compassionate appointment has still remained pending due to non-issuance of PPO till recently.

7. Now that the Pension Payment Order has already been issued, let this writ petition be disposed of with direction upon the respondent no. 3 to consider the prayer of the writ petitioner for grant of compassionate appointment in accordance with law, within a period of eight weeks from the date of communication of this order.

8. In doing so, the said respondent shall take into consideration all necessary documents and allowed reasonable opportunity of hearing, if needed, for proper disposal of her prayer for grant of appointment on compassionate ground.

9. Needless is to mention that upon finding, if at all, about the petitioner's eligibility in terms of the existing rules, for grant of compassionate

appointment, necessary expeditious order to that effect should be passed thereafter, by the said respondent.

10.With the direction as above, this writ petition is disposed of.
