Learned advocate for the petitioner submits that the private respondents are creating disturbance in peaceful possession of the property of the petitioner. Learned advocate for the State submits that the private respondents are also claiming ownership of the property concerned. The police have acted on the complaints received from both the petitioner as well as the private respondent. The police have initiated prosecution under Section 107/116 (c) of the Code of Criminal Procedure in respect of both the complaints. In such circumstances, it appears that there are civil disputes between the private parties. The private parties are at liberty to have such civil disputes resolved before the appropriate forum in accordance with law.

The police authorities having taken steps on the basis of the complaint received by them, further interference by the court is not called for.

The report filed in court today be kept with the record.
