Sri Haripada Sheet and others Mr. Shaswat Nayak .... for the petitioners Mr. Amit Baran Dash .... for the opposite party nos.1 to 3 The innocuous prayer made in the present application under Article 227 of the Constitution of India is for expeditious disposal of a declaratory suit. It is evident from the records that Title Suit No.44 of 2018 is pending for quite a long period in the trial court.

Learned counsel appearing for the opposite parties, in his usual fairness, submits on the query of court that the suit is on the peremptory hearing board.

In such view of the matter, CO No.1088 of 2021 is disposed of by requesting the Civil Judge (Junior Division), Second Court at Contai, District: Purba

Medinipur to dispose of Title Suit No.44 of 2018 pending in the said court as expeditiously as possible, preferably within four months from the date of communication of this order to the said court. The trial court as well as the parties shall act on the communication of the learned advocates for the parties, accompanied by a server copy of this order, without insisting upon prior production of a certified copy thereof.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
