Mr. Iqbal Kabir Mr. Ratul Ghosh .....for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is a house wife who used to be assaulted by her husband and other in-laws. She was finally driven out from the matrimonial home. She filed an FIR, inter alia, under Sections 85 and 362 of the BNSS on 05.03.2025. In anticipation that she might be lodging an FIR, her father-in-law lodged a false case that she had put poison in the drink of her mother-in-law. The incident allegedly happened on 01.03.2025.

Learned counsel appearing on behalf of the State relies on the injury report. It appears from the report that the victim was admitted in the hospital with a history rat killer ingestion. It was notified to the patient party that the condition of the victim was serious. Finally, the victim was discharged from the hospital on 05.03.2025 after

treatment. There are statements of two neighbours who are post occurrence witnesses. They support the prosecution case. In view of the incriminating materials available in the case diary, I do not think that this is a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
