Rabindar Kumar Sharma Mr. Tarak Nath Halder ... for the petitioner The petitioner is the plaintiff in a suit for eviction. The petitioner prays for expeditious disposal of the eviction suit. The suit is at the stage of evidence and cross-examination of PW is going on. It is submitted that the defence has been struck out and the scope of the suit is very limited. The petitioner further submits that he is a septuagenarian and a cancer patient. Thus necessary orders be passed for expeditious disposal of the suit.

As an innocuous prayer is made for early disposal of the suit, this Court is of the view that no prejudice would be caused to either of the parties. Hence, the revisional application is disposed of with a direction upon the learned Civil Judge (Junior Division), 5th Court, Alipore, South 24 Parganas to dispose of the suit within a period of one year from the date communication of the order.

This Court has not gone into the merits of the claim of the petitioner. This Court has also not expressed any opinion on the merits of the suit. The

learned court below shall proceed in accordance with law. A copy of this revisional application along with sever copy of this order be served upon the opposite party within a period of a week from date.

All the parties are directed to act on the basis of server copy of this order.
