Learned advocate appearing for the petitioner submits that the petitioner initiated divorce proceeding against the de facto complainant 3 months prior to the lodgment of the present complaint.

State is represented.

Considering the facts and circumstances of the case and considering the fact that the petitioner initiated divorce proceeding prior to the lodgment of the complaint and also considering the fact charge sheet was submitted by the police, we are inclined to grant anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest, the petitioner shall be released on anticipatory bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand Only), with two sureties of like amount each, to the satisfaction of the arresting officer and subject to the

conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 and on further condition that the petitioner shall appear before the Court below and pray for regular bail within four weeks from date. Petitioner shall also appear before the jurisdictional court on every date fixed for hearing until further orders.

Prayer for anticipatory bail is allowed.

CRM 3555 of 2021 is disposed of.
