The present revisional application was preferred challenging the proceedings arising out of Taldangra Police Station Case No.108 of 2016 dated October 23, 2016 under Sections 406/420/465/120B of the Indian Penal Code.

Mr. Mukherjee, learned Public Prosecutor, at the inception submits a report prepared by the Inspector-in-Charge, Taldangra Police Station.

Let the report be kept with the record.

The report reflects that opinion of the handwriting expert from the CID was obtained and thereafter the police authorities filed a final report with an opinion "mistake of fact". A copy of the same has been enclosed along with the said report. In the report, it also reflects that the present petitioners Nihar Kanti Ghosh and Manojit Pan have not been charge-sheeted. Consequently, the revisional application has become infractuous.

Thus, no order need be passed at this stage.

With the aforesaid observations, CRR 1093 of 2017 is disposed of.

Pending application, if any, is consequently disposed of. The interim order is hereby made absolute.
