The present revisional application has been preferred in connection with Taldangra Police Station Case No.93 of 2016 dated September 17, 2016 pending before the Learned Additional Chief Judicial Magistrate, Khatra under Sections 406/ 420/ 465/ 120B of the Indian Penal Code.
Learned advocate appearing for the petitioners is present. Mr. Imran Ali, learned advocate appears for the State and submits that the compilation of documents submitted by the Investigating Officer which, includes amongst others, the First Information Report, the opinion of the expert as well as the report under Section 173 of the Code of Criminal Procedure reflects that the report was submitted before the Jurisdictional Court as "mistake of facts". Consequently, the present application has become infructuous wherein the F.I.R. was challenged. Let the compilation of documents be kept with the record. Thus, CRR 1095 of 2017 is disposed of as infructuous.
Interim order, if any, is vacated.
All pending connected applications, if any, are consequently disposed of.
