Petitioner seeks a declaration that the disconnection of electricity supply to the factory of the petitioner on August 14, 2020 is illegal.

The learned advocate appearing for the petitioners submits that subsequent to the filing of the writ petition, supply of electricity to the factory of the petitioners was restored. He submits that there still remains disputes with regard to adjustments of service charges.

The Damodar Valley Corporation authorities are represented.

Learned Senior Counsel appearing for the DVC authorities submits that electric supply to the factory of the petitioners was not restored. He submits that the petitioners are at liberty to approach the appropriate authority for payment by way of instalments.

Learned advocate for the petitioners submits that the petitioner is ready and willing to pay by way of instalments subject to the authorities adjusting the service charges.

Apparently, there are disputes with regard to accounts. The petitioners are at liberty to approach the appropriate authority for payment by way of instalments, if so advised. The appropriate authorities are at liberty to consider the issue of adjustment, if so raised by the petitioners.

In the event the petitioners approach the authorities for instalments and consideration of the prayer for adjustment, the authorities will take a decision there on within seven days from the date of such approach. Such decision, needless to say, should be a reasoned decision and be communicated to the writ petitioner.

With the aforesaid observations WPA 6687 of 2020 (Old No. WP 6687(W) of 2020) is disposed of. (Debangsu Basak, J.)
