In Re: An application under Section 482 of the Code of Criminal Procedure, 1973;

Butus Yadav @ Ranbir Kumar

Versus

The State of West Bengal & Anr.

Mr. Saswata Gopal Mukherjee, Ld. P.P., Mr. Imran Ali, Ms. Debjani Sahu.

...for the State.

The revisional application was preferred challenging an order passed by the learned Additional Sessions Judge, Durgapur on 04.03.2017, thereby allowing the application under Section 439(2) of the Code of Criminal Procedure. The said order passed by the learned Additional Sessions Judge, Durgapur reflects that the petitioner at the relevant point of time was already in custody in connection with another case.

As none appears on behalf of the State, Ms. Debjani Sahu, learned advocate, who ordinarily appears on behalf of the State, is directed to appear in this matter. Her appointment may be regularised by the concerned authorities.

Having regard to the passage of time which has expired in the meantime and considering the materials available the learned Additional Sessions Judge, Durgapur had cancelled the bail, I am of the opinion that no interference is called for. However, the petitioner would be at liberty to exercise his rights for bail in case

there are subsequent changes.

With the aforesaid observations, CRR 1098 of 2017 is dismissed.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
