The revisional application was preferred challenging the proceedings arising out of Baranagar Police Station Case No.246 dated 30.06.2020 (G.R. Case No.3484 of 2020) as also the orders passed by the learned Additional Chief Judicial Magistrate, Barrackpore.
The petitioners approached this Court at a stage when the investigation of the case was continuing. The main thrust of contentions in the revisional application is denial of the allegations made in the application under Section 156(3) of the Code of Criminal Procedure which was the foundation of First Information Report registered with Baranagar Police Station. I have considered the contentions advanced by the
petitioners as also the allegations made by the opposite party no.2. As State was not represented, Ms. Manisha Sharma, learned advocate, who ordinarily appears on behalf of the State is directed to represent the State. Her appointment may be regularised by the concerned authorities.
In view of the settled proposition of law, I am of the opinion that no interference is called for at this stage. The petitioners would be at liberty to agitate the points canvassed in the revisional application at the stage of consideration of charges, if so advised.
Accordingly, 1235 of 2021 is disposed of.
Pending connected applications, if any, are consequently, disposed of.
