Mr. Kajal Ray ....for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Jr. Div.), 2nd Court at Serampore to dispose of the pending application in Title Suit No.460 of 2023 expeditiously. Mr. Ray, learned advocate appearing for the petitioner submits that the hearing of the application under Order 7 Rule 11 of the Code of Civil Procedure filed by the opposite parties herein is being adjourned from time to time on the prayer of the opposite parties. He further submits that the hearing of the said application has been concluded on April 23, 2025 and a date has been fixed for passing orders.

In the light of the submission made by the learned advocate for the petitioner CO 1387 of 2025 is disposed of by requesting the learned Civil Judge (Jr. Div.), 2nd Court at Serampore to dispose of the application under Order 7 Rule 11 of the Code of Civil Procedure expeditiously. Depending on the fate of the application under Order 7 Rule 11 of the Code of Civil Procedure,

the learned trial judge is requested to proceed in accordance with law as expeditiously as possible. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
