Mr. Kajal Ray ....for the petitioner This application under Article of the Constitution of India is at the instance of the proposed defendant/applicant under Order 1 Rule 10 of the Code of Civil Procedure in Title Suit No.372 of 2023 pending before the learned Civil Judge (Jr. Div.), 2nd Court at Serampore praying for a direction upon the learned trial judge to dispose of the application under Order 1 Rule 10 of the Code of Civil Procedure expeditiously. Mr. Ray, learned advocate appearing for the petitioner submits that the hearing of the said application was concluded on January 10, 2025 and April 30, 2025 has been fixed for passing order in respect of the application under Order 1 Rule 10 of the Code of Civil Procedure.

In view thereof, CO 1389 of 2025 is disposed of by requesting the learned Civil Judge (Jr. Div.), 2nd Court at Serampore to dispose of the application under Order 1 Rule 10 of the Code of Civil Procedure expeditiously. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
