Ms. Anusuya Sinha, learned advocate appears on behalf of the State/opposite party no. 1 This is an application under section 482 of the Code of Criminal Procedure, 1973 filed by the petitioners for quashing of proceeding being G.R. Case No. 1256 of 2014 pending before the learned Chief Metropolitan Magistrate, Calcutta arising out of Hare Street Police Station Case No. 338 of 2014 dated June 8, 2014 under sections 420/406/120B of the Indian Penal Code.

The matter was dealt with by a coordinate Bench on January 25, 2016, when the Hon'ble Court was not inclined to pass any interim order. Since thereafter, the matter was not heard until August 17, 2022, when both the learned advocates for the parties appeared and prayed for an accommodation. The matter is pending since 2015. Pursuant to a memo of evidence dated July 19, 2022, the matter was pending before the learned Trial Court for trial. Considering the long pendency of the matter, and in absence of any prayer for extension of interim order, this Court is of the view that there is no reason to keep the matter pending in the list. Accordingly, C.R.R. 978 of 2015 is dismissed for default.

Let a copy of this order be sent down to the learned Trial Court by the department forthwith for information and necessary action. (Chaitali Chatterjee (Das), J.)
