The Chairman of the West Bengal Madrasah Service Commission is present in court with an affidavit of compliance, which is taken on record. It is recorded that a copy of the affidavit of compliance is served upon the learned advocate appearing on behalf of the petitioner in court today.

The recommendation in the name of the petitioner ought to have been made much earlier, even after we passed the order on March 11, 2021. The recommendation was made only on June 30, 2021 after the contempt application was filed on April 22, 2021. In paragraphs 7 and 8 of the affidavit of compliance, the alleged contemnor has given an explanation for the delay in implementing the order.

In consideration of the fact that the initial order for recommendation was passed by Justice Tapabrata Chakraborty on January 22, 2021 since upheld by this court, in the event there is any deficiency in qualifying service for recommendation, the order passed by Justice Tapabrata Chakraborty on January 22, 2021 and the order passed by us affirming the said order on Marcy 11, 2021 ought to have been taken into consideration. However, the apology tendered by the Chairman of the West Bengal Madrasah Service

Commission is accepted.

The contempt application, thus, stands disposed of without, however, any order as to costs.
