The only issue to be decided is whether the memoranda no. 9008-F(P|) dated September 16, 2011, No. 4011-F(P) dated May 20, 2013 and No. 1107-F(P) dated February 25, 2016 and No. 1033F(p2) dated February 8, 2019 issued by the Finance Department, would be applicable in case of the petitioner.

The petitioner claims to be a casual worker engaged in the office of Kaliachak-III Panchayat Samiti.

The petitioner as also a representative of the Kaliachak-III Panchayat samity shall be heard. If the security of tenure, one time retirement benefit, enhanced remuneration from time to time etc. are found to be available to the petitioner by taking into consideration the eligibility criteria as per notification

of 2011, a reasoned order shall be passed and the benefit shall be given to the petitioner. If it is found that the petitioner is not eligible for such benefits, in that event, necessary orders with reasons shall be passed and communicated to the petitioner. Such order shall be communicated to all.

The entire exercise shall be completed within a period of three months from the date of communication of this order.

This Court has not gone into the merits of the claims of the petitioner.

This writ petition is disposed of.

There will be, however, no order as to costs. All parties are directed to act on the server copy of this order.
