Learned advocate appearing for the petitioners submits that the petitioners have been shown arrested and they are in custody for almost six months. The subjectmatter of the case relates to alleged recovery of 1087 bottles of Phensedyl. It has also been contended that the present petitioners have been implicated on the basis of statement of co-accused and similarly placed accused person has been granted bail on 16.04.2026 in CRM(NDPS) 531 of 2026. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail, but is unable to refute the contentions of the petitioners that similarly placed accused person has been granted bail.
Having regard to the fact that the petitioners are similarly situated as the other accused viz. Monirul Sk @ Manarul Sk @ Minirul Sk who has been granted bail on
16.04.2026 in CRM (NDPS) 531 of 2026, I am of the opinion that the present petitioners viz., 1. Fulsar Mallik @ Mollik and
2. Shah Alom Islam be released on bail on the same terms and conditions as the other accused has been granted bail in CRM (NDPS) 531 of 2026.
Accordingly, the prayer for bail of the petitioners is allowed.
The application for bail, being CRM (NDPS) 775 of 2026, is, thus, disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
