The said report reflects that there has been a direction for further investigation by the jurisdictional Magistrate being the learned ACJM, Durgapur. The said further investigation is being carried out by another investigating officer who is different from the investigating officer who submitted the charge-sheet.

Learned advocate for the petitioner submits that the address which is available in the cause title is the place where the petitioner is available. If required, notice be issued by the investigating

officer at the address appearing in the cause title of the present writ petition.

So far as progress of the further investigation is concerned, an application may be preferred at the instance of the writ petitioner before the jurisdictional court. The jurisdictional court will call for a progress report regarding the fate of the investigation. Let the further investigation be taken to its logical conclusion by the investigating officer. No interference is called for by this Court at this stage.

The petitioner would be at liberty to take steps after the final opinion is granted by the investigating officer.

With the aforesaid observations, the writ petition being WPA 6707 of 2020 is disposed of. Pending connected application is consequently disposed of.

There shall be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
