In the matter of:- Md. Abdul Salam alias Nantu Mr. Angshuman Chakraborty Mr. Shashanka Shekhar Saha .....for the petitioner Mr. Arijit Ganguly Mr. Pratick Bose .....for the State This is an application seeking an expeditious disposal of a proceeding in which a charge sheet was submitted under Section 379 of the Penal Code. Let a copy of this application be served upon Mr. Arijit Ganguly and Mr. Pratick Bose, learned counsels, who are present in court today and who ordinarily appear on behalf of the State. Their engagement may be regularised in due course by the competent authority of the State.

Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is an accused in this case. The FIR in this case was lodged on 20.03.2018 and a charge sheet was submitted on 31.12.2018. Yet, long dates are being fixed. On 17.06.2020 the next date was fixed as 08.06.2022 for consideration of charge. The proceeding has remained pending for no fault of the present petitioner. Learned counsel appearing on behalf of the State

submits that no inordinate delay has been occasioned in this proceeding.

I have heard the submissions of the learned counsels appearing on behalf of the petitioner and the State and have perused the revision petition. No prejudice will be caused to anyone if a direction is passed in respect of a prayer for expeditious hearing of the case.

Although, this is a case under Section 379 of the Penal Code initiated in 2018 and the present petitioner is on bail, yet fixing the next date of hearing after two years is quite exceptional.

In view of the above, I request the learned trial court to conclude the proceeding as expeditiously as possible by fixing shorter dates and without granting any unnecessary adjournment to any of the parties. With these observations, the revisional application is disposed of.
