Kalam Sk @ Abul Kalam Mondal & ORS v. State Of West Bengal
29.06.2021 Court No.30 rpan/ 18 C.R.M. 6126 of 2020 (Via video Conference) In Re:- An application for anticipatory bail under section 438 of the Code of Criminal Procedure ;
And In Re : Kalam Sk @ Abul Kalam Mondal & Others - Petitioners.
Mr. Tanmoy Kr. Ghosh, Mr. Arindam Sen ... for the State.
Apprehending arrest in connection with Nowda P.S. Case No.413 of 2018 dated 12.12.2018 under Sections 341/326/307/34 of the Indian Penal Code read with Sections 25/27 of the Arms Act, the petitioners have filed the present application.
Though no one appears on behalf of the petitioners, Mr. Sen, learned advocate appearing for the State, is present. He submits, upon instruction, that the petitioners herein previously filed an application for anticipatory bail, being CRM 2262 of 2019 and the same was rejected by an order dated 25th February, 2019. It, thus, appears that the present application is a second application for anticipatory bail. It also does not appear that there had been any change in the circumstances of the case after the earlier application for anticipatory bail was rejected. In view thereof, the present application, being CRM 6126 of 2020, is dismissed.
All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
