Referring to annexure P-2 at page 11 to the writ petition Md. Masudur Rahaman Paik, learned advocate appearing for the petitioner submits that, on medical ground the petitioner has submitted her application praying for Voluntary Retirement dated July 14, 2022, the same has not been considered. Learned counsel for the State submits a report dated May 2, 2025 issued under the seal and signature by Joint Director of Health Services (Nursing), Government of West Bengal, the same is taken on record. The report shows that, the said
application seeking Voluntary Retirement is under process.
In view of the above, the respondent no. 4 is directed to come to a logical conclusion of the said application submitted by the petitioner dated July 14, 2022 upon furnishing reasons in support of such conclusion. The said reasoned decision then shall be communicated to the petitioner.
In the event, the petitioner is required to produce any further documents and records she shall be communicated as such and the petitioner shall produce all such necessary records and documents before the respondent no. 4 forthwith.
The entire exercise including communication of the reasoned decision to the petitioner shall be carried out and completed by the respondent no. 4 positively within a period of six weeks from the date of communication of this order.
In the event, the reasoned decision goes in favour of the petitioner and the petitioner is allowed to avail of Voluntary Retirement, the appropriate authority of the employer of the petitioner then shall take all necessary and consequential steps in accordance with law forthwith.
Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents.
On the above terms and conditions, this writ petition, WPA 9185 of 2025 stands disposed of, without any order as to costs.
