Mr. Susnigdho Bhattacharyya, Ms. Sarmistha De ...for the petitioner In this application the petitioner has prayed for a direction upon the Court below for expeditious disposal of SPL (P) No.09 of 2023 presently pending before learned Additional District & Sessions Judge, Bongaon.

Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner submits that the FIR was lodged on 22nd January, 2023 and after completion of investigation police submitted charge sheet on 28th February, 2023. Thereafter, the Court below framed charge on 7th September, 2024. Prosecution proposes to examine six witnesses, out of which, they could examine so far only one witness and nobody knows when the trial would be concluded and, as such, he prayed for necessary direction upon the Court below. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite parties will have no cause to prejudice and, as such, service of copy of application upon the opposite parties is dispensed with.

Having considered submission made on behalf of the petitioner and that the trial has got stalled since 20.02.2025, I find that the prayer made by the petitioner is justified and is required to be allowed to secure the ends of justice.

In view of above, the instant application being CRR 1709 of 2026 is hereby disposed of with a direction upon the Court below to make best endeavour to expedite the trial of SPL(P) Case No.09 of 2023 and to make his best effort to conclude the entire proceeding preferably within a period of six months from the next date of hearing.
