None appears on behalf of the State respondents in spite of service.

The petitioner alleges that the application for grant of MR Dealership filed in the year 2013 pursuant to a vacancy notification published by the SubDivisional Controller (F & S), Jhargram is yet to be disposed of by the respondents.

The petitioner earlier approached this Court by filing a writ petition being W.P. 15255 (W) of 2018 which was disposed of on 4th September, 2018 directing the respondent District Controller, Department of Food and Supplies, Jhargram to dispose of the application filed by the petitioner within a stipulated time period and to intimate the fate of the application to the petitioner.

According to the petitioner, the application was taken up for consideration by the respondent authority but the fate of the application is yet to be communicated.

A communication made by the District Controller (Food and Supplies), Jhargram dated 8th August, 2019 to the petitioner mentions that information has already been sought for from the Director, Directorate of DDP&S and necessary approval against the recommended applicant has duly been sought for, but the information is yet to be received at his end. The petitioner submits that the authority, after the pandemic, did not take any step to intimate the fate of the application to the petitioner.

It appears from the submission made on behalf of the petitioner and from the documents annexed to the writ petition that the matter is pending consideration at the end of the respondent authorities.

The Court in the earlier writ petition filed by the petitioner directed the District Controller to intimate the fate of the application to the petitioner. The same has not been done till date.

In view of the above, the instant writ petition is disposed of by directing the District Controller (Food and Supplies), Jhargram to immediately intimate the petitioner the fate of the application made for grant of MR Dealership at the earliest.

In the event no approval has been issued by the Directorate, the same shall also be communicated to the petitioner.

All efforts must be taken to intimate the petitioner the fate of the application latest within 30th July, 2022.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
