The matter is listed today for hearing. On call none appears for the petitioner/husband and opposite party/wife.
On perusal of the record, I find that order dated 8.9.2011 has not been complied with by the husband by filing affidavit of service in respect of the opposite party.
The petitioner has assailed the order dated 22.3.2011 passed by learned Sessions Judge, Paschim Medinipur in Criminal Revision No. 243 of 2010 whereby learned Sessions Judge reversed the judgment and order of learned Judicial Magistrate, 1st Court, Paschim Medinipur dated 3.7.2010 in Misc. Case No. 268 of 2004. By the impugned order, learned Sessions Judge has allowed maintenance of Rs.2,000/- per month to the wife. No interim order was passed.
Since the petitioner did not come forward with an affidavit of service, considering the facts and circumstances of the matter and the non-compliance of the earlier order, the revisional application is dismissed for default.
Let a copy of this order be sent to the Court of learned Sessions Judge, Paschim Medinipur for information.
Accordingly the matter is disposed of.
