Re : An application under Section 482 read with Section 401 of the Code of Criminal Procedure.
This revisional application was filed praying for quashing of the proceedings in connection with Shyampur P. S. Case No. 330 of 2020 dated 01.11.2020 under Sections 498A/506 of the Indian Penal and Sections 3 & 4 of the Dowry Prohibition Act.
The contentions advanced in this revisional application is based on the letter of complaint which was treated as formal F.I.R. The contentions advanced by the private opposite party in the application under Section 125 of the Code of Criminal Procedure. The prayer for anticipatory bail of the petitioner being allowed has also passed certain directions passed in other proceedings. So far as the revisional application is concerned, the records which have been enclosed reflect that the petitioners approached the court when the investigation was under progress. The investigating agency was yet to submit its opinion under Section 173 of the Code of Criminal Procedure.
As none appeared for the State, Ms. Manisha Sharma, who ordinarily appears
on behalf of the State is directed to appear in this matter to represent the State. Her appearance may be regularized by the concerned authorities in due course. Having regard to the nature of the arguments which have been enclosed and the contentions which have been advanced, I am of the opinion that none of the grounds were assigned are worth consideration for termination of a police investigation being carried out.
With the aforesaid observations, the revisional application being CRR 1241 of 2021 is disposed of.
Pending applications, if any, are consequently disposed of. Interim order, if any, is hereby vacated.
