The petitioner has assailed the order dated 16th February, 2024 passed by the learned Additional Chief Judicial Magistrate, Alipore, South 24 Parganas in CGR no. 181 of 2023 refusing his prayer for return of the seized mobile phone.

It appears from the report submitted by the State that the seized mobile phone has been sent for forensic examination and report is yet to be received.

In view of the above, the revisional application is disposed of with liberty to the petitioner to renew his prayer for return of the mobile phone after submission of report by the Cyber Forensic and Digital Evidence Examiners Laboratory, Criminal Investigation Department.

It is expected that the prosecution shall make all endeavours so that the expert's opinion/ report is submitted within a reasonable time.
