Saket Gambhir v. Narcotic Control Bureau

No. 29 CHC Rejected C.R.M.(A) 1629 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with NCB Crime No. 30/NCB/KOL/2022 dated 08.12.2022 under Section 8(c) read with Section 20(b)(ii) of the Narcotics Drugs and Psychotropic Substances Act, 1985.

And In the matter of : Saket Gambhir ...... petitioner Ms. Darshika Tahlani ....for the petitioner Mr. Kallol Kr. Basu ....for the State NCB seized the parcel containing intermediate quantity of narcotics.

NCB claims that petitioner did not respond to the notices at all.

NCB also claims that parcel contained name and address of the petitioner.

It is the contention of the petitioner that there is no criminal antecedent so far as petitioner is concerned. Petitioner is a student. Petitioner is being falsely implicated. As noted above, parcel containing intermediate quantity of narcotics was seized by the NCB at the Airport containing name and address of the petitioner.

Complicity of the petitioner at this stage cannot be overlooked.

We are unable to grant anticipatory bail to the petitioner. CRM (A) 1629 of 2023 is rejected.
