This revisional application challenges the order dated 4th April, 2011 passed by the learned Sub-Divisional Magistrate at Katwa in the proceeding in M.P.Case No. 152 of 2011 under Section 97 of the Code of Criminal Procedure. By the impugned order, direction was given to the petitioner to hand over six month old child to her father.
The revisional application was never admitted. Direction was given to serve notice that was not complied with.
Heard Ms. Mukherjee, learned counsel for the petitioner and Mr. Panda, learned counsel representing the State.
This application, in my view has become infructuous as the child has attained the age of discretion.
The revisional application since devoid of merit stands dismissed.

Since the matter is appearing long after 14 of July, 2011.
Department is directed to issue administrative notice upon the parties.
