The revisional application has been preferred challenging the proceedings arising out of C 7373 of 2005 pending before the learned Metropolitan Magistrate, 11th Court, Calcutta under Section 138 of the Negotiable Instrument Act. Record of the revisional application reflects that no interim order was passed at the time of hearing in the year 2011 by a coordinate bench of this court. Today, when the matter has been called, none appears to apprise the present stage of the case before the learned court below.

Having regard to the contention so advanced by the petitioner, I am of the view that the same are issues to be raised during the course of trial. Accordingly, no interference is required.

Accordingly, CRR 1399 of 2011 is dismissed.

Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
