Kausik CRM (NDPS) 779 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with NCB Crime No. 01/NCB/KOL/2024 dated 10th of January, 2024 under sections 8(C)/20(b)(ii)(C) of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that the accusations against the petitioner relate to alleged recovery of 2 Kgs.100 Gms. of Charas. Charge sheet has already been submitted. Charge has been framed and the petitioner is in custody for 2 years and 3 months. On any stringent condition, learned advocate for the petitioner prays for bail including the factum of health grounds of his wife who is suffering from cancer.

Learned advocate for the NCB opposes the prayer for bail and submits a report. Substantial time has passed since the petitioner is in custody. Only 3 witnesses, till date, has been examined. Rest of the 3 witnesses proposed to be cited by

the prosecution be completed within a period of 6 months from the next date fixed. Learned Trial Court, if it finds that, in spite of co-operation extended by the present petitioner, the trial cannot be completed, the learned Trial Court would release the petitioner on bail on such terms and conditions as he deems fit and proper.

Needless to state that, no unnecessary adjournment be granted to any of the parties and the trial of the case would proceed in spite of any resolution of the local bar. Accordingly, CRM (NDPS) 779 of 2026 is dismissed. Registrar General, High Court, Calcutta is directed to communicate this order to the learned Trial Court. Report submitted be kept with the record.
