No. 29 CHC Rejected C.R.M.(A) 1635 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Baishnannagar Police Station Case No. 753 of 2021 dated 28.12.2021 under Sections 21(C)/29 of the Narcotics Drugs and Psychotropic Substances Act.

And In the matter of : Safikul Sk.

...... petitioner Mr. Abdul Momen, Mirza Firoj Ahmed Begg, Ms. Rita Patra ....for the petitioner Mr. Swapan Banerjee, Mr. Suman De ....for the State Commercial quantity of narcotics were seized from the house belonging to the petitioner.

In such circumstances, conscious possession of the petitioner over the seized commercial quantity of narcotics cannot be overlooked.

Consequently, we are of the view that petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985.

CRM (A) 1635 of 2023 is rejected.
