It is submitted that the connection could not be effected due to obstruction caused by respondent nos. 5 to 7.
Learned counsel appearing for respondent nos. 5 to 7 submits that the petitioner has suppressed material facts, specifically the pendency of a civil suit between the parties. It is further submitted that, in the said suit, a competent Civil Court has passed an injunction order restraining the parties from altering the nature and character of the suit premises.
Learned counsel appearing for the West Bengal State Electricity Distribution Company Limited (WBSEDCL) submits that officials of WBSEDCL visited the premises for the purpose of providing the electricity connection. However, due to obstruction from respondent nos. 5 to 7, they were unable to effect the connection. It is also submitted that, in
light of the subsisting injunction order, the connection could not be effected.
It is well settled in law that the grant of an electricity connection does not confer any right, title, or interest in the property, nor does it alter the nature or character of the premises in question.
In view of the above, there is no justification for withholding the electricity connection to the premises. The Officer-in-Charge of Rampurhat Police Station is directed to extend necessary assistance to the officials of WBSEDCL for effecting the electricity connection, at the cost of the petitioner. The police shall also be at liberty to break open the padlock of the meter room, if necessary, for the purpose of effecting such connection.
Accordingly, WPA 9088 of 2025 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
