Kausik (Allowed) CRM (NDPS) 781 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 213 of 2026 dated 11.02.2026 under Sections 21(C)/25/27A/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that he is innocent and has been falsely implicated in the instant case while he was returning from Court. The police authorities have vindictively arrested him and there are no seizures from the petitioner's possession, neither there is any association of the present petitioner with any of the accused persons who have been arrested in connection with the instant case.

Ms. Arushi Rathore and Mr. Sayan Mukherjee, learned advocates appear for the State. Their appointment may be regularized by the concerned authorities. Learned advocate for the State opposes the prayer for bail and submits that from the leading statement of the present petitioner there has been

recovery of 509 Gms. of Brown Sugar and the petitioner was named by one of the accused persons.

Having considered that the investigation of the case is in progress, at this stage I am not inclined to release the petitioner on bail.

Accordingly, CRM (NDPS) 781 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
