18.04.2023 sdas rejected C.R.M. (NDPS) No. 786 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Cossipore Police Station Case No. 28 of 2020 dated 19.02.2020 under Sections 20(b)(ii)/29 of the NDPS Act.

And In Re : Prosenjit Mondal ..... petitioner Mr. Debasis Kar ... for the petitioner Mr. Ranadeb Sengupta ... for the State Learned Counsel for the petitioner submits there is delay in trial. He prays for bail.

Learned Counsel for the State opposes the prayer for bail and submits trial is in progress and three witnesses have been examined.

Statements of witnesses and contemporaneous document i.e. seizure memorandum show recovery of narcotics i.e. 22.5 kgs. of Ganja above commercial quantity from the joint possession of the petitioner and co-accused. Trial is in progress. Three witnesses have already been examined. Under such circumstances we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.

Trial court is directed to expedite the trial and conclude the same at an early date preferably within one year from the

next date fixed for recording evidence without granting unnecessary adjournment to either of the parties. Parties are directed to communicate this order to the trial court for necessary compliance.
