Kausik (Allowed) CRM (NDPS) 782 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Kaliachak Police Station Case No. 1880 of 2025 dated 05.11.2025 under Sections 21(C)/27A/29 of the NDPS Act.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for almost 5 months and has been implicated on the basis of statement of co-accused. The subject matter of the case relates to alleged recovery of 1 Kg. 200 Gms. of Brown Sugar from the possession of other coaccused persons.
According to the learned advocate, prosecution has relied upon 15 witnesses in order to prove its case. As such, some time will be required for which the petitioner's detention is unwarranted.
Ms. Arushi Rathore, learned advocate is directed to represent the State. Her appointment may be regularized by the concerned authorities. Case diary has been produced by the learned advocate appearing for the State. Learned advocate for
the State opposes the prayer for bail and submits that petitioner has a criminal antecedent of a dacoity case. So far as the locus of the present petitioner in respect to the case is concerned, although there has been no recovery from him but names of certain persons transpired from whom there has been recovery.
I have taken into account the fact that the case was registered on 05.11.2025. There has been no recovery from the present petitioner. There are no CDRs and/or money transactions and there is no possibility of the trial being completed very soon as it has been informed that till date charges have not been framed.
Having considered the overall circumstances, I am of the opinion that without entering into the merits of the case, the petitioner, because of his locus in respect of the whole of the proceedings, may be released on bail.
Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Md. Goffar Sk @ Abdul Goffar Sk, shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, Special Court (under NDPS Act) cum Additional District Judge, 3rd Court, Malda. If on bail petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not
leave the jurisdiction of District of Malda without the prior permission of the learned Special Court.
Accordingly, CRM (NDPS) 782 of 2026 is allowed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
