Petitioner Mr. Atis Kumar Biswas Mr. Amit Singh Mrs. Shailaja Gupta ...for the petitioner Mr. Sandip Chakraborty Mrs. Rituparna Saha ...for the State Learned counsel appearing on behalf of the petitioner submits as follows. There was a scuffle between the victim and others. The alleged victim went to the police station and lodged an FIR. It was only after about eight days that he was again admitted to the hospital and thereafter, he passed away. The petitioner is not standing on the same footing as one Amit @ Amit Kumar Bin, whose application for anticipatory bail was rejected by this Court earlier. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He relies on the post-mortem report which shows that death was caused due to the injuries inflicted. Among other things, there was a scalp hematoma, a fracture over the right parietal region, dislocation of right sided anterior ribs and hemorrhage noted in both the kidneys. He also refers to the dying declaration of the victim, which specifically names the present

petitioner as one of the assailants. He refers to the statements of eyewitnesses which also specifically implicate the present petitioner. Considering the above, the other incriminating materials available in the case diary and the fact that a similarly circumstanced coaccused was denied the benefit of anticipatory bail, I do not consider this is to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail is rejected. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
