Mobarak Khan v. The Chief Secretary, Govt Of W.B. & ORS
ss/jks 07.02.2022 WPA 7511 of 2018 Mobarak Khan Vs.
The Chief Secretary, Government of West Bengal & Ors.
(Through Video Conference) Mr. Jahar Lal De Mr. Shamim-ul-Bari ... ... for the State This PIL was filed in the year 2018. Thereafter, more than three years have passed and no one is present today to prosecute this petition.
Having examined the record, we find that the grievance raised by the petitioner is in respect of payment of car hire charges of `2,600 and `2,700/- made by the respondent no. 6 on 27.02.2013 and the allegation is that the respondent no. 6 had released the said payment to the respondent nos. 12 and 13 along with tiffin packet amounting to `5,100/- illegally. The petitioner has also challenged the order of the District Magistrate dated 19.02.2015.
A perusal of the said order clearly indicates that the issue has already been examined by the District Magistrate and it has been found that the type of vehicle was ascertained and the concerned vehicles were found to be buses and not cars and the allegation in this regard has been found to be incorrect.
In view of this, we are of the opinion that at this stage no case for interference in the present petition is made out which is accordingly dismissed.
